Provisions on the Administration of Ship Port Services

     Article 1 In order to promote the healthy development of the shipping industry, regulate maritime declaration endorsement services, and facilitate and serve the parties, these regulations are formulated.


     Article 2 These regulations are applicable to the endorsement service work of the maritime administrative agency for the ship's maritime declaration.


     Article 3 The Maritime Safety Administration of the People's Republic of China is the competent authority for the endorsement of maritime declarations.


     Maritime management agencies at all levels are specifically responsible for the endorsement of maritime declarations within their jurisdiction.


     Article 4 When a ship applies for the endorsement of the maritime declaration, the maritime administrative agency shall endorse the maritime declaration that meets the requirements.


     Article 5 The meaning of relevant terms in these regulations:


     (1) "Maritime declaration" refers to the ship, cargo damage, environmental damage, casualties, etc. caused or likely to be caused by severe weather or accidents, as well as other accidents on the ship. Declaration submitted by the regulatory agency;


     (2) "Maritime declaration endorsement" means that when the maritime administrative agency applies for the maritime declaration endorsement for the ship concerned, it shall review the content of the maritime declaration in writing, and the endorsement "approved for reference" indicates that the ship has declared relevant maritime declaration matters to the maritime administration agency the behavior of;


     (3) "Extended maritime declaration" refers to a more specific and detailed supplementary declaration submitted by the ship within 7 days after obtaining the endorsement of the maritime declaration.


     Article 6 The maritime administrative agency shall meet the following requirements when accepting applications for maritime declaration endorsement:


     (1) The ship should submit a maritime declaration to the local maritime administration agency within 24 hours after the incident arrives at the first port; if damage to the cargo in the cargo compartment has occurred or may cause damage to the cargo before the vessel arrives at the port, it should submit the maritime administration to the maritime administration agency before opening the vessel. Declaration materials.


     (2) The applicant for the endorsement of the maritime declaration (hereinafter collectively referred to as the "applicant") shall be the captain, but other relevant personnel may submit it on his behalf. When submitting the application, the submitter should show his identity document (seaman’s card and other national documents, the same below) for original verification.


     (3) The maritime declaration document may be in multiple copies.


     (4) When the ship submits the maritime declaration, it shall attach a copy of the supporting materials, including the master certificate, the ship’s nationality (or registration) certificate, crew list, weather report (if relevant) and other relevant materials to prove the declaration Content.


     (5) The applicant must sign and affix the ship’s seal on the maritime declaration, and there should be at least two witnesses’ signatures and copies of their identity documents.


     (6) The maritime declaration shall be in Chinese or Chinese and English.


     If the captain is dead or the key materials are damaged and the materials cannot be delivered in accordance with the above regulations, the applicant shall indicate the relevant circumstances.


     Article 7 The main contents of the maritime declaration shall include:


     (1) The basic general situation of the ship: the name of the ship, nationality, port of registry, ship identification number or IMO number, name of the owner, operator and manager (if any);


     (2) Cargo loading on ships: departure port and destination port, passenger and cargo situation;


     (3) Information related to maritime declaration matters: time, location, weather, sea conditions, main course of the event, measures taken, damage or possible damage, etc.


     Article 8 After the maritime declaration is filed, the applicant may submit a more specific and detailed extended maritime declaration within 7 days.


     After the maritime declaration is accepted, an accident other than the endorsement of this maritime declaration occurs again, and the application for maritime declaration should be resubmitted.


     Article 9 The applicant is responsible for the authenticity of the submitted maritime declaration and accompanying materials.


     Article 10 After receiving the maritime declaration and accompanying materials, the maritime administrative agency shall only conduct a written review.


     If it meets the requirements, it shall be stamped on the spot with the “approved for reference” chapter and the serial number shall be prepared.


     If the materials and information are found to be incomplete, they shall be notified of the supplementary materials and information at one time, and their applications after the updated materials and information shall be accepted.


     Article 11 The texts endorsed by the maritime administrative agency shall be in Chinese, and English may be attached when necessary.


     Article 12 Under the following circumstances, the maritime administrative agency shall refuse to sign the maritime declaration and inform the applicant:


     (1) Violating national laws and regulations;


     (2) The submitted materials are fraudulent.


     Article 13 The maritime administrative agency shall keep an endorsed maritime declaration document and its supporting materials, and establish a corresponding account, and other endorsed maritime declarations shall be returned to the applicant.


     Article 14 The endorsement of the maritime declaration by the maritime administrative agency does not affect the investigation of the maritime declaration submitted by the ship by related parties.
